谁有高见? 取消建房合约是否要上法庭? (水城百事)

我们和一个小建筑商签了一个盖房子的合约,我们双方是同一个经纪人。几天后我们又问了mortgage经纪,她说你们现在的收入很难配得起这个数字的mortgage, 我们就发短信给经纪(一周内)。他同意我们填取消合约的表,然后会让建筑商签。近一个月后,经纪告诉我们,建筑商说签过的合约不能变,我们要取消合约得赔他2万元,不然就法庭上见。我们认为没有给建筑商造成任何经济损失,不应该赔他2万元。经纪问我们是否要上法庭,请lawyer.请问谁有高见?

如果是有贷款条件的合同,在规定的时间里,银行或贷款公司给你出具证明,你是可以取消这个合同的

一般都有这个条款,在合约的Schedule A 里, 你再看一下,如果你没有签这个条件的Waiver, 你是可以逃离的。像这种情况你的合约里要再加一条Lawyer Approval的条款,让律师再给你看一下。

Early Termination-conditions (k)
The purchase Agreement may include any condition that is for the sole benefit of the purchaser and that is agreed to by the Vendor (ie.,the sale of an existing dwelling, Purchaser financing or a basement walkout). 是经纪卖给我们的,但不知道是经纪卖地builder建房,经纪替builder卖地又卖房, 还是他俩合伙的。因为这个经纪还替这个builder卖别的房。

天后我们又问了mortgage经纪,她说你们现在的收入很难配得起这个数字的mortgage, 这部分应该是想到买房之前要做的基本功,几乎所有的地产网站上都有计算公式,先计算一下,再做一个excel表列出家里的所有收入和日常支出,知道自己能买的房子的最高价钱可能是多少,然后才开始看房!
